He said the machines are in the control of a third party.

The judge reversed the order not long after, explaining that the defendants are not in possession of the machines.

“Plaintiffs’ request fails because the voting equipment that they seek to impound is in the possession of county election officials. Any injunction the Court issues would extend only to Defendants and those within their control, and Plaintiffs have not demonstrated that county election officials are within Defendants’ control. Defendants cannot serve as a proxy for local election officials against whom the relief should be sought,” the judge wrote.

The change of course by the judge drew a flabbergasted response from Lin Wood, an attorney associated with the Trump campaign.

“What??? Judge reversed order based on Defendants’ claim that GA Counties control voting machines,” Wood wrote on Twitter, adding that the machines are owned by the state and that the Georgia secretary of state administers elections.

“Why are GA officials determined to wipe these machines clean [by] resetting them?”

his reasoning is that the defendants (people being accused) argued they have no control over what counties do with these machines because according to them, each county election board owns their own machine and its not up to either Governor nor Secretary of State to tell them what to do with them.

Since Lin Wood did not bother to name every single County level election official in the fucking state as the defendant on his lawsuit, according to the judge he is out of luck on this.

The judge is also suggesting that if they disagree, it should be the plaintiff's responsibility to delve into state bureaucracy and produce definitive evidence showing that any of the named defendants have authority over what happens to these voting machines.

He must've been threatened/pressured. Maybe someone has blackmail on him. But he reversed the order on the most narrow of grounds, which is what they do when they don't want to take the time to hear the case. They'll find something procedurally wrong with it, and dismiss it on those grounds. It's a bitch move. Maybe SCOTUS will do something?
