Need to show the courts that you tried to remedy the issue in good faith before the certification. It’s kinda like libel lawsuits, you first have to demand a correction or retraction. If they follow through you don’t have a case. If they don’t follow through with the correction, then You can sue. You can’t sue unless you first try to remedy outside of court, the suit would be thrown out as you don’t have a complaint if the other party was never in writing asked to do anything.
I suppose there are multiple paths to victory. But I share your sentiment. Something like this should have never happened in the first place, and the matter should never have to go to the Supreme Court. It should have investigated and handled at the state level.
