The state legislators by the constitutions are the only ones who can select appointees to vote at the electoral college. This is sole in our hands (people) what do you think all these hearings are for? In the event a swing states cannot appoint votes at the electoral college the total 270 becomes unattainable for both candidates. The house of representative decides, however by law each state has 1 vote.
