This matter was already tested and resolved during the civil war, when people were actively killing each other en masse, and Lincoln still lost that battle (rightly so).
If he uses the insurrection act to call on the unorganized militia, he could then court martial any able-bodied male aged 18 to 45. According to this anyway:
