Hello everyone, many are asking about why the House is not in session on this, our final day of session for 2019-20 Legislative Session.
It is physically impossible to pass a joint resolution as has been proposed by Sen Mastriano in one day. It is a constitutionally and rules governed process that takes three days in the house and two days in the Senate for a total of five days. Even a simple one chamber resolution takes three days in the house. In both cases there are not enough days to pass either one and he should know that.
On this final day of session, the House resolution was introduced today. No resolution was introduced in the Senate.
Additionally, the resolution that was proposed in the House does NOT actually change the electors. It simply says we have concerns with the electoral process and does not actually reassign the electors. I know it is being sold as something else entirely based off the emails and comments I have received but I encourage you to actually read the resolution that is being circulated in the House.
With regards to the Resolution being proposed, several provisions of the Pennsylvania Constitution are important.
The Pennsylvania Constitution outlines in Article 7 Section 13 how contested elections are handled in Pennsylvania. I would encourage you to review this. (https://www.legis.state.pa.us/.../legis/LI/consCheck.cfm...)
Article 2 outlines the Legislature and how it functions. Importantly, the legislative term ends November 30 (today). The new legislature is sworn in on the first Tuesday in January. Once the session ends, the General Assembly cannot act until the newly election General Assembly is sworn in.
The General Assembly considers both Resolutions and Bills. A Resolution can be a Joint Resolution, passed by the House and the Senate (as proposed by the Senator), or a simple Resolution considered by just the House or just the Senate. Article 3 deals with Bills, which are the sole method to create law. Article 3 Section A subsection 4 requires all bills to be considered on three separate days in each chamber, House and Senate.
Article 4 Section 15, or the presentment clause, requires bills to be presented to the Governor for approval or veto. The law requires many Joint Resolutions to be presented to the Governor as well. A simple resolution is not presented to the Governor.
All of these provisions are relevant to the Resolutions being proposed by Senator Mastriano and Representative Diamond. Constitutionally, the legislative session ends today. There are not the required 6 days left to move a bill.
My understanding is that Representative Diamond's resolution and Representative Mastriano's resolution are not the same. This is also important if an attempt to pass a joint resolution via two separate simple resolutions is what is planned. I do not believe there is any legal precedent for this, but at a minimum the same language would have to pass both chambers.

I had concerns about the activist PA Supreme Court Weeks prior to the election and I and my staff personally worked with Rep Everett to move the election integrity committee out of State government committee. It would have had complete oversight and subpoena power and been in place PRIOR to the election if enough people would have been willing to vote for it. Instead, many of the same members now calling for more oversight after the fact, said they would never vote for it and put out press releases saying so which meant we did not have the 102 votes to pass it.
This means the only remaining option is the court process outlined in section 13 of our state constitution that directs how contested electors are to be litigated and the campaigns are doing so now. We as the House also have a case pending before the United States Supreme Court.
In either approach the Constitution and our rules do matter and must be followed. We cannot create legislative days or simply ignore that requirement.
I understand that is not the answer you want to hear, but I do believe someone should tell you the truth about what is being proposed vs what can actually be done.

It would have had complete oversight and subpoena power and been in place PRIOR to the election if enough people would have been willing to vote for it. Instead, many of the same members now calling for more oversight after the fact, said they would never vote for it and put out press releases saying so which meant we did not have the 102 votes to pass it.
This means the only remaining option is the court process outlined in section 13 of our state constitution that directs how contested electors are to be litigated and the campaigns are doing so now. We as the House also have a case pending before the United States Supreme Court.
In either approach the Constitution and our rules do matter and must be followed. We cannot create legislative days or simply ignore that requirement.
I understand that is not the answer you want to hear, but I do believe someone should tell you the truth about what is being proposed vs what can actually be done.
I am inspired by the passion many of you are showing on this topic, as I am any time constituents want to engage on the many issues facing our Commonwealth. Our election process will continue to be the focus of an investigation by our State Government committee, and we will continue to look at legislative fixes to ensure every Pennsylvanian has faith in the election processes and outcomes.

I don't understand, how is he blocking the entire state legislature? I thought it was republican controlled? How does it depend on this 1 man?
As I understand it, since he is the Speaker, he has to call an emergency session, since the PA legislature is no longer in session.
Is there not a way for the legislature to go into session without being called by the speaker if they have a quorum?
I know nothing about PA law but seems really dumb that 1 man can stand in the way like this.
Get 50%+1 of the legislature to convene with or without him and get them all to vote. He cannot stop them, only they can stop themselves. The Constitution gives them the power and the duty.

I am not a PA resident but I picked an address in his district and called his office to let him know that he only has one choice and that is to stand up for the constitution and that his decisions don't just affect PA, it affects us all.
