Guess- Trump is waiting for the supreme court first. He doesn't want to make big moves before SCOTUS. If Scotus rules in his favor, he wants it perceived as the reasonable adults siding with Trump. If he declares martial law prior to that, it will always appear as if scotus was bullied into siding with him.
