I follow what you are saying up to a point. Where you are wrong is that criminal justice would be moved WAY up in importance if the shoe were on the other foot. Imagine if you will that a black Democrat candidate was losing an election due to Republican election fraud with some kind of racism overtones. I guarantee you the DOJ would criminally investigate the heck out of that, and share their homework with the civil lawsuits to ensure the electoral outcome wasn't subject to fraud.
So I believe the DOJ could act if they just had the spine to, and if it wasn't entirely populated by filthy commie Democrats. Nowhere is it written that evident crimes must be ignored and not followed up on until all civil suits are exhausted.
