Well it depends, because Zucker lives in Florida, which is a two party consent state, and he could have been doing calls from there. But I doubt there are any legal issues, because O'Keefe knows better and he would run everything by a lawyer. Let's keep in mind that when he got charged before when he was younger, he was charged wrongfully. He's always done his due diligence to know what he can and can't do.
