No, he's a US Attorney. Part of the DOJ. The DOJ regulation clearly says that the Special Counsel has to be someone who is not part of the US government. That means Barr appointing Durham as a Special Counsel directly goes against that regulation. But Barr even says in his memo that 28 CFR 600 applies to Durham, so there's no way he doesn't know this. red flag red flag red flag
