They don't have to actually rule on it themselves, they can reverse the dismissal and force the state SC to rule on the conditionality of the law. That's the way they wriggle out, the state supreme court overturns the law but stops short of reversing the outcome. That'll make it easier for the SCOTUS to stop short of throwing out all those votes.

I hope that's not the reality, an unconditional election should be tossed, but i don't have confidence that they have 5 votes to toss the election, I've been disappointed too many times by the court stopping short of how they should rule.

No, this is a different case. This is about the PA Constitution limiting absentee voting and would need to be modified to allow the type of election they just did. The legislators tried to amend the PA Constitution, then dropped it, and made a law doing the same, while renaming absentee to mail-in voting or something like it.

The case you are referencing is about the PA Supreme Court changing the meaning of election day to mean 3 days after election day.

This is great because the original lawsuit was profound. It's a god damn travesty that it was dismissed for "lack of standing" and other game playing bullshit. What it really was is "we're democrat judges and we don't care about the rights of republicans, which is indeed a violation of the first and 14th amendments. Anyone know why Sean Parnell is the first to file with Scotus? Were his cases rejected in the lower courts faster? Seems like this case should have the President's legal team on it, but I am definitely not a lawyer.

It’s a more straightforward case than most. It’s a simple legal question on the surface: was Act 77 constitutional, or was it not? And if it’s not constitutional, what does that mean, legally speaking? This is something that can be decided in large part by SCOTUS without an evidentiary trial.

On the other hand, as it stands right now, the best thing SCOTUS could say for a lot of the other cases is that the trial court judge has to actually listen to evidence. SCOTUS can’t rule on fraud—which is a factual issue (did fraud occur here or not)—without evidence in the record. And no judge has (yet) issued an opinion after looking at the factual record.

Because no case has been dismissed on the merits (i.e. after hearing the evidence) yet. Most of the big cases have been the victims of "motions to dismiss" because of a lack of standing or other procedural flaws. Normally SCOTUS will not review rulings on motions to dismiss because they are not rulings on the merits of any constitutional issue. The same is true of this Parnell case, but he makes a good case. However, the only remedy the SCOTUS can give is to send it back for a full hearing before the original judge. They can't themselves decide that Act 77 was illegal and throw out the mail-ins. However, Parnell has asked SCOTUS for an injunction to stop the electoral process pending the SCOTUS' decision on whether to review the dismissal of his case. If he wins that, then it at least screws things up for a while, and sends a signal that there were problems with this election.
The only case that is actually currently before SCOTUS on the merits is Republican Party of Pennsylvania v. Boockvar--but that case is about the late ballots in PA that were segregated. The briefing is finished at SCOTUS and they could decide any day if they will take up the case.

I cannot imagine this not being picked up by the Supreme Court. This is the most important election in our time. There is no way that the Supreme Court Justices don't know what is going on. One of the key things I keep going back to is how in the hell did Conservatives ride a Red Wave this election and the guy leading the charge loses? How? We have all been watching this since 11-3-20. The amount of evidence at this point is staggering. If the court doesn't save us then something is really fucked up.

Hmm, I’m not sure this is a litmus test, and I personally wouldn’t read too much into a denial. There’s a very easy out for Alito and others here—that this is a Pennsylvania issue that doesn’t clearly implicate federal law. They may be looking for cases that clearly fall under the federal constitution. Those cases are a bit behind this one on the timeline.

That would seem very hard to justify. The brief makes a strong case that the PA court denied them their constitutional right to be heard in court.

The PA court said "sorry, you can't challenge the law before an election actually happens, because you haven't been harmed yet", then when the election happens and they challenge it, the court said "sorry, you can't challenge the law because you didn't file the challenge straight after the law was passed". It seems a pretty clear case.

Reading through this... I can't imagine there aren't many other states that rushed their absentee ballot laws, and they are in fact unconstitutional. Without researching, I'd still guess that it would be easy to flip another 7 house seats that were won with absentee ballots alone. So my question is,

4 Justices are required to grant cert. There's Trump's 3 picks, and Thomas. Alito might be a deciding vote but he voted with the other 4 on the NY case, and Pennsylvania snubbed Alito on his orders to ballot separation.

How long does it usually take for the SCOTUS to vote on whether to accept the case? That is the first step and that cannot be taken for granted. They need 4 Justices to agree to hear the case.

Remember, the SCOTUS deadlocked 4-4 in October on whether to hear the Pennsylvania case allowing late ballots to be accepted.

Granted, Alito instructed PA to separate the late ballots if the case came up again. But the vote should not have been that close to begin with.

4-4 on whether to count ballots received AFTER Election Day. That should have been 8-0.

That’s the key question, pede. They can do any number of things. Parnell is asking that the court nullify certification and either throw out the illegal ballots or direct the PA legislature to choose electors. But SCOTUS is not bound to these requests and can instead determine on its own what it thinks is fair.

They could easily rule that the PA court was wrong to dismiss the case, and send it back down to them with orders that they allow it to continue, and reinstating the original injunction against certification. That seems like the "least intrusive" ruling from SCOTUS' perspective.
