He's not saying definitively he has evidence, he's saying these pencil dicks are so corrupt they fear any discovery as it will lead obviously to their crimes (a la why Killary didn't push back on Trump's 2016 win, because any audit of votes would've revealed what we now know about election fraud).
If they sue him, then he is entitled to all the legitimate evidence available to prove his claim.
He can subpoena bank records, communications, etc. Anything and everything that helps build the case that any of these officials had contact with members of the CCP, as well as shady dealings.
Lin could ultimately lose the case, and be forced to pay damages, but the real damage would be whatever comes out through discovery. The officials could technically win in the court room, and still have their lives destroyed. (The evidence gathered for the civil suit could also be subsequently used in a criminal prosecution.)
