I don't understand how this is not the law anyway. If a fetus leaves the womb it is a baby, and a legal person under any legal definition - no matter what you think about abortion. You can't even make the argument that it is "just a clump of cells" and part of the woman's body, because clearly it is not and therefore killing it is murder. Neglecting it by failing to give the baby care is negligent homicide or infanticide.
What's amazing is that there is even a debate about this issue.
