I would think it could be resubmitted in an appeal or re-added to the complaint if the case continues. If I remember the initial reasoning was the Def didn't have time to review it before today.
So this sets the precedent that it’s perfectly okay to cheat so long as the cheat is sooo big that it takes “too long” to completely capture in a couple of weeks???
Honestly I think they know it's going to the supreme court no matter what they rule so they are going to toss anything on any charge just to not waste their time and effort..... that and they are currupt as fuck
Not sure there is a statute of limitations of fraud and if so it has to be beyond 30 days or some legislature mumbo jumbo. After all if one robs a bank they don't say since its been past 30 days since you robbed it we can't prosecute you or you get to keep the money!

I saw that today and the argument sounded different to me. It sounded like the defense was claiming that they didn't receive the list of names with enough time to look through them, only a couple of days ago, and the plaintiffs had the list since Nov 20 or 23.
I could be wrong - I'm not a lawyer and the audio wasn't very good.
