I would think it could be resubmitted in an appeal or re-added to the complaint if the case continues. If I remember the initial reasoning was the Def didn't have time to review it before today.

Not sure there is a statute of limitations of fraud and if so it has to be beyond 30 days or some legislature mumbo jumbo. After all if one robs a bank they don't say since its been past 30 days since you robbed it we can't prosecute you or you get to keep the money!

I saw that today and the argument sounded different to me. It sounded like the defense was claiming that they didn't receive the list of names with enough time to look through them, only a couple of days ago, and the plaintiffs had the list since Nov 20 or 23.

I could be wrong - I'm not a lawyer and the audio wasn't very good.
