It seems like it was a matter of technical definition of "sex/gender"

Gotta get rid of the laws that allow for more than than male/female first

Otherwise, if SCOTUS rules it's ok to discriminate against the fake but "technically" legal definition of sex-gender, that would legally mean it would be ok to also discriminate against men/women (male/female).

Gotta get rid of those multi-gender laws first.
