We've been waiting for Alito to respond.

No.. no this is actually news from yesterday. We've been talking about it all day.

NeoDragoon 37 points ago +40 / -3

No, the news from yesterday was that Alito put forth a petition to Roberts, this is that it's actually been docketed.

Looks like it got picked up without anyone noticing then, still YUUUUGE.

Notice how the twitter law shills are silent. I remember them saying how its after the deadline and theyre not taking it serious lol.

I'm praying the SCOTUS sees the blatant over reach of these psycho governors using covid to rule like dictators.

Electors are picked on the 8th I believe.

This is Alito telling PA to fix your own fucking problems.

Just checked. "safe harbor" is the 8th.

Case is on the docket as of Dec 3.

Source: https://www.supremecourt.gov/search.aspx?filename=/docket/docketfiles/html/public/20a98.html

If someone tries to say "Safe Harbor" Alito will say: "Case was on the docket."

It 100% applies. They certified the election on the 24th. Once the 8th comes, unless the election has been decertified by the state or a court, the electors go to Congress. Congress is the only body that can refuse the electors after midnight on the 7th. I don't know if SCOTUS could take that away from Congress considering the plain language in the constitution. That is even if they were willing to.

SCOTUS can do whatever the fuck they want, the only question is whether everyone else goes along with it.

Please re-read pede (pg 2, para1):

https://crsreports.congress.gov/product/pdf/IF/IF11641

I seriously doubt this will be resolved by Tuesday EOD and it has zero to do about the certification of the electors if this deadline is passed.

I'm going to link you over to my extended breakdown of this, and then to how it relates to the decision in Bush V. Gore. Give it a read and let me know if I'm crazy. Not a Lawyer, but I am a military legal clerk for what it's worth.

Safe Harbor does not supersede litigation.

Not if its contested

If only PA didn't delegate selection of electors to the Governor. This could come down to two certificates of election being presented. I forget how that scenario plays out, but it is either Pence selects what certificate to accept or the electoral college pauses to debate it.

Pence decides as he is president of the senate

I’m pretty sure Pence decides on his own because he oversees the electoral vote counting

It's cool, the SCOTUS website shows that it was officially docketed on the 3rd, but yeah there are a lot of moving parts right now.

You're not alone man, I've been wondering where the punishment would be for violating the order, and there have been so many cases, from so many people. It's sort of like the back and forth with Georgia and the Dominion machines, but they appear to have been destroyed anyway. I'm just glad I've been on staycation this week, because I don't know what I'd do to keep up with everything going on right now.

Can we talk about this safe harbor date on December 8th.

1

State is being contested. No safe harbor. Been on the docket since the 3rd.

So what are the possibility of outcomes here? Can judges throw out the whole vote? or parts of it? What is likely to happen?
