The next important date in the process applies only to States that have disputed election results. Recent experience shows that it is possible that there will be challenges or recounts in some States. If a State has a contested outcome, it must meet the “safe harbor” deadline15 of December 11, 2012, or risk having its disputed electoral votes decided by Congress. Meeting the safe harbor deadline guarantees to States that Congress will accept their election results. If an election dispute is not resolved by the State before the safe harbor deadline, Congress has discretion over the disposition over the State’s electoral votes.
