the constitution was violated so yeah. But the relief is a different thing. They could throw out 2M votes, or they could do nothing. Or maybe something like throw out the election

The Supreme Court typically does not rule on State issues unless they infringe on federal statutes or the Constitution. This would break long standing tradition. So I would not get any hopes up.

Only if it violates the United States Constitution. Typically if it is in violation of the State Constitution, they allow the State's Supreme Court to have their rulings. There are no laws however preventing the Supreme Court from intervention, and there is the argument that the State's court has been in gross violation of the Constitution. I am not aware of this level of corruption reaching the Supreme Court before.

I would assume state level fraud on a federal level, especially that alters the outcome of the Presidential vote, would warrant the tradition break.

Yes. Or even the Equal Protection clause. However, we are talking about Conservatives here. Tradition and precedent are held in very high regard. We are asking Conservatives to venture out into more liberal territory. If this was a liberal majority they would do it without hesitation for a Democrat. However I don't know if our Conservative Justices understand that we are at war for the very fabric of this country.

They could simply rule the State must take up the case, since the state has placed them in a catch 22. The state dismissed it because it was too late since it happened after the election, but the same state dismisses cases if the election hasn't happened yet.

This would allow them not to appear partial, avoid ruling on it themselves and uphold the Federal part of the constitution.

Also, any election that has a federal candidate gives jurisdiction to the Supreme court.

Today is the 6th of December. We only have 8 days left until the Electoral College votes. We don't have too many next weeks left. Once they vote, and if Biden gets the necessary 270, it may be too late. Call me a Doomer. Call me a Concern Troll. I don't care. Time is running out, and that my friends, is the reality of the situation.

Your points are right. I'm all over these boards calling the anti-doomers our equivalent of the REEEEEEEEEEEEEEEing left. They cuss, call names, and fly off the handle if you say anything based in reality.

I would add to your comments that we should be contacting all these state legislatures HARD I. The dwindling time you've noted. Flood their emails. For those of us who have time, call them. Urge Pennsylvania (and all the other legislatures) to have a special session regardless of what the governor says. We all know that if things were the other way around the Democrats would be meeting and having special sessions regardless of whether or not they're opposing party governors called the session or not. And that should be noted in emails and calls to these senators. Tell them to grow a spine like the Democrats have.

Selecting and sending the electors is there explicit constitutional right in duty.Pennsylvania passing the buck to Congress and telling them to dispute the electors is spineless, gutless, and isn't going to happen. They need to do it. Be flooding the zone. Here is a link to a TDW thread I started. there's a Google doc in it. Each sheet has the emails of every Republican house representative and senator and all these battleground states. There are some old emails and such, and you're going to get some failed delivery messages in each string. but it's the most comprehensive list that's out there. You can copy the entire legislature into one email and reach all of them simultaneously in a matter of seconds. You don't have to jump in and out of the contact forms that you'll find on the states' government websites.

That may be true. However, once the electors vote on the 14th, it is going to make it much harder to get the Supreme Court involved IMHO. At that point, there had better be some very compelling evidence, or I don't think they will get involved. And even then, it us going to an uphill battle. So buckle up and get ready.

Because of the inevitability of precinct by precinct "curing" or "not curing" the SCOTUS should declare mail in voting unconstitutional. There is no way to prevent unequal protection under the law.

Now as for precedent that helps this well we got all the "segregation is inherently unequal and therefore unconstitutional" court cases. Swann vs Charlotte Mecklenberg being one of them I think.

The state didn't separate the ballots as ordered, so it may be they throw out the entire vote. I can't picture them letting the violation of a direct order slide.
