December 8th is the 3 USC 5 deadline to resolve election issues.

What if the legislature convenes for a short time on the 8th and immediately votes an appointment of the electors, then immediately closes the session?

There is NO TIME for counter measures by the rest of the government or the democrats.

No need to rely on the Supreme Court to waive the December 8th deadline.

IIRC, SCOTUS voted 7 to 2 that FL SC's 5 to 4 (second decision, after admonishment by SCOTUS -- first decision was 9 to 0) to change election laws after the FL state election was unconstitutional, leaving in place the FL Sec State's certification of final vote. Most people remember only the separate SCOTUS decision of 5 to 4, when 2 of the 7 agreed it was unconstitutional, but wanted a do-over. Fun times!!

No. The role the state legislators can play is in the slate of electors that are presented to congress.

But if contingent election, then it depends on the make up of their congressional delegation. If a state has 10 seats in HOR and 6 are Rep then the one vote goes to the Rep. Now, I don't know that even if they are majority Rep that they have to vote for the Rep.

Basically the way I understand it, is Dec. 8th is a federal statute and it does not supercede the constitution. I think it's kind of similar to how these legislators have delegated their powers to select electors, but as per their constitutional duty they can take those powers back at any point.

Similarly these dates are fine if everyone decides to go by them, but it could legally be contested as the constitution only recognizes one date.

The 12/8 and 12/14 dates are statutes not the Constitution.

The white paper linked argues that those statutes only apply if the states followed their election law and don’t apply if there’s fraud.

Since the elections didn’t follow state law and were fraudulent the December dates in the statutes can’t be used by the Dims.

I'm not so sure. The super-lawyer from the GA hearings told them that they do NOT need Kemp or the SOS OR a 2/3rds majority to hold a special session. He said that Federal law supercedes that, they can call it on their own.

The legality of doing so will be surely be challenged, but they can do it on their own and let the chips fall where they may.

This Petition comes after the Senate Judiciary Subcommittee was inundated with affidavits, signed under penalty of perjury, from citizens all over the state who testified to blatant election fraud and many violations of the law that have taken place during the 2020 General Election as well as during the follow-up recounts.

“We recognize our duty to move forward with this Petition due to the level of fraud and violations of law which took place during this 2020 election cycle. We urge others to join us,” stated Sen. Ligon. “We need at least 29 signatures in the Senate on the Petition before 9 AM, Tuesday, December 8, 2020. A similar Petition in the House requires at least 91 signatures by that same time. As the Petition makes clear, testimonial and other evidence given before the Georgia Senate Judiciary Subcommittee demonstrated a systemic failure to observe Georgia Election laws. Underage individuals and convicted felons registered and were allowed to vote. People voted who were not listed in the state's records as having been registered to vote. Voters who moved to a different county more than 30 days prior to the election and failed to re-register were allowed to cast votes. Voters registered using bogus addresses such as UPS facilities and other stores, yet their votes counted. Ballots of individuals who were deceased prior to Election Day counted. Over and over again, ballots were counted outside the view of poll watchers or designated monitors, defying the law. Even the law itself was modified by an unconstitutional agreement which weakened signature verification requirements for absentee ballot applications and absentee ballots as set out in Code Sections 21-2-381 and 21-2-386.

According to committee members, that was just a part of the testimony that came before them and much more is still being submitted. Any certification of electors by the Governor of Georgia or the Georgia Secretary of State in light of such systemic failures, the Petition states, would not be in conformity with the Georgia Election Code enacted by the General Assembly pursuant to its plenary power. Therefore, following Supreme Court guidance in Bush v. Gore, 531 U.S. 98 at 104, a state legislature, "after granting the franchise in the special context of Article II, can take back the power to appoint electors.”

“We believe we have reached the point that the results of this election are untrustworthy,” stated Sen. Burt Jones. “Such pervasive disregard for election laws by our election officials requires a decisive response. It is time for our legislative body to do its job.”

Best we can hope for in these states is for the individual legislatures to pull back any certification of the vote being unable to determine a fair winner due to fraud, inconsistencies, and incompetence. Its too late to determine a winner, will take months maybe a year to unravel the mess. If enough decertify then it goes to the house and state delegations. If they pick wrong then they get the boot in two years, the constitution gave it to the house because its members are closer to the people and more accountable than any other elected office. The SC can do the same, but they will not install a winner, by the constitution they can't.

Why is it too late to determine a winner? In Wisconsin, it's illegal to send absentee ballots to those who didn't request them. They did it anyway. Eliminate those ballots. Trump wins. In Pennsylvania, the judiciary branch circumvented the legislature to allow mail-in ballots to come in after election day. Eliminate those ballots. Trump wins. So on and so on.

Because not all the mail in ballots were Bidens... most sure but there were some for Trump and now there is no way to determine who's votes are whose from that illegal stack. All that can be determined is that the entire pool is tainted with numbers of ballots exceeding the margin of victory. Once the illegal votes were mixed in the ship sailed for determining a winner. In one of the states those votes were supposed to be sequestered and kept separate but got mixed in anyway... don't remember which state. Don't get too focused on the numbers, all we have to do is show that there were more illegal votes than the margin needed to claim the entire pool is tainted and the election is undeterminable.
