Couldn't this be rigged so that whichever party controls the majority in terms of either the house, or state delegates (whichever it is) just decides who the next president is by manipulating this?
IANAL, but I don’t see anything specified in the 12th amendment that addresses how contested electors of specific states are resolved by either VP or Congress. It seems like that procedure may be covered by the Electoral Count Act which appears to be a hot mess and of questionable constitutionality.
You’re definitely right as far as the actual contingent election would go: 1 state, 1 vote. But I fear the acceptance of contested electoral votes may come down to straight votes of each chamber. But again, IANAL and wouldn’t mind being wrong about that!
