You have to prove to a court that you have a history of making films perhaps and that your film had intention to reach an audience with the type of theatrical presentation that normal movies have.
But in a court you have to argue that you're actually making a movie- it has to be believable to a jury. One way to sway the jury, I'd say, is to have an established history of movies... or some sort of legitimate publishing of this movie to count as a movie. It needs to really be a movie, in other words. How you get about that can be a creative endeavor
If your channel has a history of posting movies/a reputation that can be perceived by a general public as posting movies then that would count. 50 subscribers probably not

Get restaurants to put a camera and just film the inside - with a sign explaining they're shooting b roll to sell - and the dining area is officially a movie set.
Just FYI, as far as I know, SAG (union) productions have been requiring COVID tests for all on set talent and crew. Don't know about indie productions. It's bullshit because they're basically leading the way for mandatory vaccines.
