Its real simple! Follow the damn Constitution (the law of the land) is all we are asking for! Anytime you intentionally try to subvert that law you commit Treason!
In all Cases affecting Ambassadors, other public Ministers and Consuls, and those in which a State shall be Party, the supreme Court shall have original Jurisdiction. In all the other Cases before mentioned, the supreme Court shall have appellate Jurisdiction, both as to Law and Fact, with such Exceptions, and under such Regulations as the Congress shall make.
^ confirmed. I believe the inference is that if other state has been shown to have voter fraud it effectively dilutes a proportion of all remaining states votes in a presidential election. This allows ANY other state to lodge this complaint, not just Texas. This aside, Judge Alito's decision today is pivotal. If he grants a 'stay' pausing Pennsylvania from progressing with electors it's likely Pennsylvania's electoral votes will be voided or add further time to allow a meaningful investigation and extend deadlines. Likely also that if he grants a stay, other states will file similar suits. This would be a massive WIN from Trump and also provides a good indication of how seriously SCOTUS is viewing allegations of fraud. To me, Alito's interest in taking on this case screams NOT SO FAST YOU COMMIE TRAITORS! - Trump is gonna wreck these traitorous mofos when he's elected.
True. SCOTUS also knows that Dems talking about packing the court will make their role redundant. I suspect/hope Alito will make additional recommendations i.e. State wide audit + investigations and prosecutions for subversion. Could happen. Also sets precedence for other States, could well see a snowball effect here. The first domino may well be about to topple.
The Judicial power of the United States shall not be construed to extend to any suit in law or equity, commenced or prosecuted against one of the United States by Citizens of another State, or by Citizens or Subjects of any Foreign State.
Look at that second clause! "commenced or prosecuted ... by Citizens of another State". The third clause also refers to citizens.
This just means I cannot sue Pennsylvania in Federal court. And a Georgian cannot sue Texas in Federal court.
But Texas can sue Pennsylvania in Federal court because Texas is not a citizen of Texas -- Texas is a State, and the AG represents Texas as a State in Federal litigation, so the Texas AG has every right to bring suits against other States in Federal court.
And Article III, Section 2, second paragraph, of the U.S. Constitution says:
In all Cases affecting Ambassadors, other public Ministers and Consuls, and those in which a State shall be Party, the supreme Court shall have original Jurisdiction.
which means that cases involving a State go straight to the Supreme Court. The 11th Amendment forbids suits by citizens of other States, but not by other States, so the Texas suit must go straight to the Supreme Court, and it can be heard because it's not ruled out by the 11th Amendment.
Playing Constitutional lawyer is relatively easy because the Constitution is very small and as long as you've been reading up on SCOTUS cases for a couple of decades then you can have a pretty good idea of what's up!
Of course, the SCOTUS has twisted various parts of the Constitution into pretzels. Very sad.
Ohioan here as well... are you saying Ohio was the first to sue these states? If true I am honestly shocked but thoroughly pleased especially considering the duck RINOs we are bogged down with.
Just to be clear and accurate, Ohio brought a friend-of-the-court brief on Nov 9 in the Pa suit. They did not, and have not, joined a any suit against another state about mail in ballots. Nobody is forgetting Ohio, because Ohio hasn’t done anything all that noteworthy. Now is their shot.
Yup! Someone posted a link to the Jay Sekulow show from yesterday where they talked about Alito moving the PA brief deadline to 9am today and towards the end of the show they talked about how other states can go straight to SCOTUS if they have concerns about other state's votes because it dilutes their votes.
IMO after reading a lot of different takes from Jerome Corsi, basically this can be done in a matter of hours IF they hear the case.
I'm not sure how the timeline works, but from my understanding it's very likely that the Justices already have their arguments prepared. They just need to agree to hear the case.
They decide if they want to hear the case or not, but I'm not sure how this works now that's it an actual state doing the lawsuit.
"In all Cases affecting Ambassadors, other public Ministers and Consuls, and those in which a State shall be Party, the supreme Court shall have original Jurisdiction."
For real, every single state that has any decency left needs to get on this and file together. Texas is a big giant, but get most of the states together and SCOTUS will be FORCED to intervene.
I'm not responsible for your parents failure to raise you properly. Take it up with them.
While you downvoters were busy with what's popular, I was doing stuff like correcting the repeated new threads claiming a 26% switch in dominion machine counting, when it was 0.26%.
Make sure you cite a source when you post a thread.
lol obviously you're reaching into your bag of words and stringing together whatever you think will hurt "deplorable_yankee"s feelings. "your parents failure to raise you properly?" what are you even getting at? you going low with petty insults simply because you did not look at the sticky threads front page first? thats on you. you literally forgot to look at the bulletin board, then asked what the bulletin board said, then got mad when someone said "look at the bulletin board"
On one side this is great news. On the other... it is a precedent of sorts espcially if it works. States will now use this in every election that goes the "wrong" direction ( for either side)
well they would be completely in their rights to do so if it was a completely fraudulent election.
If they believe their constituents votes were cancelled out by the other States, and have the abundance of evidence we see before us, then they should go for it.
Sounds like a total autist Ted Cruz move
If SCOTUS does this, do you think all the legislators will appoint electors that will vote for Trump?
Its real simple! Follow the damn Constitution (the law of the land) is all we are asking for! Anytime you intentionally try to subvert that law you commit Treason!
There is also an issue of equal protection.

Hmm?
TN should join in! Just like the Alamo
At least 35 states can file.
BIG DICK ENERGY STATE
It’s a win-win for Texas. Either Texas has a reason to leave the union or they win the lawsuit.
This is de way.
You mess with Indiana, North Dakota, Alaska, et. at.
You don't mess with Texas!
i believe this is the first 7 pages of the law suit filed by Texas

Ohioan here. I'm getting a little salty over this lol. We brought suit on November 9th.
Ohioan here as well... are you saying Ohio was the first to sue these states? If true I am honestly shocked but thoroughly pleased especially considering the duck RINOs we are bogged down with.
I don't have a link right now, and I believe it was smaller in scope, but ohio and several other states sued over mail in ballots in November 9th.
NICE! Email Dave Yost anyway and tell him to join the Texas suit!

Neat how long until SCOTUS case? I hate waiting

Does texas have enough room for all of us?
No?
Let's all be like texas instead.
For real, every single state that has any decency left needs to get on this and file together. Texas is a big giant, but get most of the states together and SCOTUS will be FORCED to intervene.
Who do we have to call? Is there anyone TO call?
Hoosier here - our cucked rino governor wouldn't file suit unless kentucky did first, Holcomb doesn't do anything unless ky's daddy andy does it first
Former Hoosier here...and sorry to hear that. Mitch was pretty bad back in the day too.
Yes. Post a source in the comments, please.

What does your unwillingness to click hot have to do with how I was raised?
You have to take that up with your parents.
Nah, they were just great. Talk to yours about teaching you that not everything needs to be gift wrapped. Have a nice night, Sincerely.

so you are incorrect and I expect you to downvote your own comment now out of humility, thank you doomer
So can we sue California for nullifying us with all their illegal immigrants voting.
Sure, but connected to elections ?
You can only use it if a state violates their own voting laws in which case it should be used.
