So, from a cursory reading, with a limited amount of understanding of the US Legal precedents, the response by the defendants appears to be telling the SCOTUS what it should do, not asking for the granting of a decision as to the merits of the application.. If i was a Justice, I would be somewhat irk'd by the upstart whiny tone of the response and the limited amount of actual, relevant, law. However, "you are so fucked" is not an appropriate, if entirely valid, response for a SCOTUS Justice to say...

i've not seen the original lawsuit, and maybe i am misjudging it based on this response, but the response does not argue in favor of Governor and SoS over-riding anything.

They claim that the meat of the lawsuit it that Act 77 is unconstitutional by state law, and they provide arguments to why they think it is constitutional.
