Well the judge cannot render a judgement against Flynn (meaning judging him guilty or pursuing other 'charges'). So it may be that he wants additional information on the original case.

The only two judgement options available are to dismiss the charges (which would render the pardon irrelevant), or to not dismiss the charges (which would render the pardon relevant).

There is literally no other judgement options available.

In this cause it actually would. It would be a hard sell to a jury that someone committed murder if they were being arrested for something they were already pardoned for publicly and chose to defend themselves from basically being kidnapped.

Sullivan needs to be criminally investigated. Review all his communications and correspondence. Search his home and all of his devices. This is clearly some kind of coordinated plot. This judge cannot overrule a presidential pardon just because he feels like it. There is no constitutional basis for his actions.

If there is some rational explanation like a brain tumor causing him to act this way then just remove him from the bench. But if he is conspiring with leftist groups to persecute Gen Flynn then he needs to be impeached and imprisoned.
