Remember, this is a case of original jurisdiction. I think SCOTUS has to take the case.
The next move will be for PA, GA, WI and MI to dismiss based on some sort of sovereignty grounds. If TX gets past that motion, the evidence will be presented to SCOTUS in the first instance, NOT through the conduit of the District Courts, where SCOTUS would reverse and remand back to them to try the case.
If they can get past the procedural hurdles, this is actually a brilliant suit by Texas. Texas could save the Republic.
