My fiance is in Medschool - they've totally cucked it. Most residency programs now ask any white person about their "White Privilege" at the interview. Also, the New England Medical Journal, which is one of the foremost medical journals, put an anti-Trump message in its journal to the entire medical establishment. It's horrid what's going on there.

Injunctive relief, also known as an injunction, is a remedy which restrains a party from doing certain acts or requires a party to act in a certain way. It is generally only available when there is no other remedy at law and irreparable harm will result if the relief is not granted. The purpose of this form of relief is to prevent future wrong. Such orders, when issued before a judgement, are known as preliminary injunctions that can be punished as contempt if not obeyed. Due to its coercive force, a grant of injunctive relief is subject to immediate review by an appellate court. The standard for review is an abuse of discretion. As such, an injunctive relief will be overturned if the appellate court finds that the trial court issued the relief based on an misapplication of the law or an erroneous factual finding.

Injunctive relief is generally only granted in extreme circumstances. The party seeking a preliminary injunctive relief must demonstrate: (1) irreparable injury in the absence of such an order; (2) that the threatened injury to the moving party outweighs the harm to the opposing party resulting from the order; (3) that the injunction is not adverse to public interest; and (4) that the moving party has a substantial likelihood of success on the merits. In considering these factors, courts have been described to apply a "sliding scale" approach where the more likely a movant will succeed on the merits, the less irreparable harm (to the movant) needs to be shown in granting the injunction. There is no mathematical means of balancing these factors, therefore, the "sliding scale" approach is based on a court's intuitive judgement. It is worth noting that courts will not find irreparable harm where the damages sustained are calculable. New York has held that in such situations, monetary damages serve as an adequate remedy.

Under the Federal scheme, Rule 65 codifies the requirements for injunctive relief.

What this actually means

SCOTUS denied PA GOP’s emergency injunction to decertify election results before SCOTUS hears the case. The case will still go on without it.

What an emergency injunction is

This is a request to for the court to something necessary without the case being heard yet.

For example,

If you were denied asylum by a judge, and your deportation is in a week.

You can appeal your case decision to an appellate judge, but the appellate judge can only schedule your hearing in a month

You would request an emergency injunction on a stay on your deportations, so that you can still be here in a month to argue your case

Judge approves emergency injunction for this reason.

This is not an approval or denial of asylum case. The person still needs to argue his case and then the appellate judge would approve or deny.

On the contrary, if your deportation was actually 2 months from now, the appeal judge would deny it because it is irrelevant

This is what happened in this case

PA GOP requested an emergency injunction that SCOTUS decertified election results, but SCOTUS ruled that certification is irrelevant.

PA Case continues, and they still have to argue thier case to the SCOTUS if scotus takes it on.

Exactly, SCOTUS's remedy would be to inform Congress to not accept the electors from these States or to only accept them for a given candidate if it's proven the other candidate won according to the legal process established (unless overridden by the Legislature, which is untested ground, AFAIK).

PA certifying their election results means nothing, SCOTUS will just overrule the certification if the time comes.

From what I can tell, this is just procedural. The case is still active. Only the petition for injunctive relief was denied. Kelly can now file for cert to have the case docketed, and he may still do that. Or it could be pointless now since Texas has filed what may be a stronger suit in the long run. We may find out as soon as Thursday.

Either that or it has not been docketed yet.

I did skim through the application and it is indeed a request for an emergency injunction.

I know that there is an actual case, not an injunction.

Case is very solid too.
