If Texas pulls this off, I'll get a Texas flag tattoo. I live in Ohio, by the way. LOL

Are there any theory to the outcome of this lawsuit?

Will SCOTUS invalidated electors?

25
DesantisDotWin 25 points ago +25 / -0

If I understand it correctly the lawsuit seeks that PA,MI,WI, and GA elections be voided and sent to their respective legislators to assign electoral college votes per the constitution.

Italians_Invented_2A 13 points ago +13 / -0

Our other path is that the legislators don't send any elector.

In that case we go to a contingent election in Congress where we should win

9
anteracorp 9 points ago +9 / -0

In the event of a contingent election, all 50 states get one vote, right?

Has there ever been a contingent election?

We can be confident if the state legislatures don't follow the will of their voters that the words Texas BBQ will take on new meaning in Ga, PA, Mi and WI

So glad I live here. I call bullshit on Texas turning blue. Let’s see what it’s like when we stop the cheating.

11
Cyer6 11 points ago +11 / -0

Even with all the ballot cheating in Houston, Dallas and Austin, we elected a lot of RED to our state this year. If we clear up all this election fraud in Texas, it will never go blue. Also, a lot of cucks don't want to live here because of the bugs, snakes and heat so we're getting a lot of MAGA voters moving in who don't mind those things. The only thing that pulls in leftists are big tech companies moving here.

2
monkeycat2010 2 points ago +2 / -0

Someone on this site commented to me that Texas stayed Red only losing 100k votes. That is 100k votes in the wrong direction.

More people are flooding this state that vote Blue. I live in downtown Dallas and it is a hot bed of Blue flaky liberals who have no idea they are voting for their own destruction.

As Texans we need to put a stop to the Blue infection.

I've only been in the dessert, are bugs really bigger in Texas?

2
Cyer6 2 points ago +2 / -0

Not where I'm at north of Austin. Lots of critters around like possums, cayotes, bobcats and a few snakes, and lots of little lizards to eat the bugs. Haven't seen any scorpions but I've had some good sized hornets fly into my house. Pretty easy to bat out of the air with a tennis racquet. The biggest thing people complain about around here are the fire ants. They'll get you pretty good if you're bare foot in the grass.

Heard you guys just joined Texas in filing the lawsuit. Kudos to Jeff Landry!

7
Liberty49220 7 points ago +7 / -0

Getting other states to join Texas in this is really important or this may die on the vine. Even though it has original and exclusive jurisdiction of state v. state claims, SCOTUS frequently denies a state leave to file its "bill of complaint." A majority of the justices must agree to accept the case (only four needed to grant certiorari). Plus the standard of proof is higher to win -- basically clear and convincing. If you want to educate yourself, here is a link to a law review article. https://lawrepository.ualr.edu/cgi/viewcontent.cgi?article=1399&context=appellatepracticeprocess

2
IKnowNothing 2 points ago +2 / -0

I agree, more states on this case is much more preferable to individual suits.

I’m not a lawyer, and from my understanding (correct me if I’m wrong) - The only issue is that article is about the appellate process which doesn’t apply here. There is no previous ruling from a lower court being appealed. Also certiorari isn’t required as there was no lower court in this matter.

As you stated, SCOTUS has “original” jurisdiction over inter-state matters such as this one and as SCOTUS has exclusive jurisdiction over these matters, it wouldn’t make any sense that they could deny such a suit as there is no other court to step in.

Maybe a constitutional lawyer could weigh in.

2
TakingBackCA 2 points ago +2 / -0

This is mostly correct. Cert is not a requirement. This is an original jurisdiction matter. It will be docketed and given due process. But, Liberty49220 is also correct. The motion for leave to file a bill of complaint is required. That motion will be heard (not summarily dismissed like in a cert case), but it is a procedural hurdle.

1
Liberty49220 1 point ago +1 / -0

I frequently litigate cases in federal courts of appeal (not SCOTUS however). Based on my quick research, SCOTUS denies about half of the petitions it receives to invoke its original and exclusive jurisdiction. That's why a few more states intervening on the side of Texas will help. I'm not a doomer! But I think even the conservatives on SCOTUS would prefer that the states or Congress decide the election than SCOTUS, e.g. under the 12th Amendment.

How the ruling of SCOTUS in favor of Texas, favors Trump?
