The ruling basically states that the constitution defines election day as one day, and any votes after midnight on election day cannot be counted.
The ironic part is that the 2000 election could have been decided in about an hour if anyone had asked the SCOTUS about this unanimous 9-0 ruling from 1997.
The exact same situation applies to the 2020 election. But, the legal geniuses have to ask the SCOTUS for a ruling citing this case. The SCOTUS can't do their work for them.
They’ll point to a difference between votes being cast versus counted after midnight. I don’t think 3 current SCJs, who were on the 2000 B v G case, would have missed an easy win with a ruling from 3 years prior. It’s more likely to not have been applicable. I hope it is this time, though. A slam dunk SC case to give Trump the win is preferable to a narrow one that will be contested by cable news every day.
