What she is saying is that it may not be legally appropriate to just “join” the lawsuit. But she does support the notion and even made a video.

If there’s a lawyer here that can shine a light. How easy and how fruitful is it to join a lawsuit?

I think what she’s saying is that if it’s appropriate to join, they will join. If it makes the case harder by joining then they won’t join. I think it’s all about whatever option works the best legally, they will do that! Seems fair enough!

I don't think a state CAN join the current lawsuit. Imagine if you could change who the plaintiffs or defendants were at any time during the course of a trial. Someone comes up with a smoking gun against you, whoops, you tag team in another person and continue the same case?

No, no, no. I'm pretty sure the only official legal option available at this point is filing what is called an amicus brief. It's an official letter of support. However, we are on a very expedited schedule so I don't even think there is time for that. Usually the courts will invite amicus briefs for a period of 30 days to give everyone who wants to voice an opinion time to file.

Other states could certainly also file their own lawsuits, but these take time to write, even if Texas is giving some good ideas, other states might have unique issues or laws or harms that present a stronger case. Texas obviously planned this ahead of time. For other states to draft an equally compelling lawsuit would take more time than it would probably take for the Supreme Court to decide what happens with the Texas case.

So be happy for these public statements of support, don't feel like it's a cop-out that does nothing substantial. I guarantee that if oral arguments are heard, the Supremes will be hearing about them from whoever else is called to argue the Texas case.

So AR and and LA seem like the two states that will very likely be joining Texas. Other states will probably follow we just don't know which yet.
