If no one responds to the complaint i think they are obliged to hear it..but they can dismiss (as courts have been doing) based on some response from the defendant. The states Will respond but if its the same old "no standing, lack of merit, case is moot, laches" crap i don't think it will hold the same weight in SCOTUS as it did in lower courts.
