In theory you could argue that the existing law might allow for shooting someone in cases you don't really intend except we're not actually seeing any specific cases of that.

I get the impression she and her kids believe they have the right to steal Trump signs from gardens without fear of being shot. When it comes to that's basically the only problem she actually presents.

The satire could actually properly reflect her position whether she realises it or not. It's hard to tell. He explanation of what she intends leaves something to be desired.

What she's actually proposing is a bit weird if you think about it. She's mixing up the term property as to actually mean house rather than the whole lot.

So it's a bill specifically only allowing you to defend your house but as long as they're robbing what's in your garden then apparently that's fine.

I don't understand where the garden came into this. I think what she is saying is homeowners shouldn't have the right to shoot someone who has broken into their home armed or not. You're already not allowed to shoot someone stealing a trump sign from your yard or breaking into your car if you're not in it. In fact, most states you're not even allowed to booby trap things like sheds, barns or signs etc.

Either way it's insane. It'll never pass in Texas. Hard to believe there are states out there who have "duty to retreat" laws period. You break into my house I'm not trying to figure out if you're just there for my TV or you're there to hurt me, I'm not going to wait and see if you're armed either. I'm in FL though. Ron just beefed up our castle doctrine.

On her twitter. She's saying she things stealing a garden ornament should not receive the death penalty. I'm not sure to what degree I might agree with that. It still depends. Also if you choose to steal a garden gnome then that's you choosing the death penalty.

She's also saying crap that it might embolden people to take justice into their own hands. People don't have a personal police squad on call 24/7 so its necessarily on all the people to be prepared and equipped to take justice into their own hands if need be.

She's not presenting any cases like this and I don't really think people shoot on sight like that if it seems petty and if that's not allowed then she the hell is she talking about?

Even if the bill is trying to legalise theft it's not doing it right.

The critical thing is that some property is irreplaceable.

There's no insurance scheme for that.

The problem here is that if you're going to basically steal home insurance for social welfare probably because the democrats embezzled tax pay money meant for social welfare and national insurance already then why involve the home owner at all or why actually steal anything?

Why not go straight to the insurance company and they can pay you protection money instead not to rob the house you were about to rob or something?

In Minnesota this is basically already law. You have duty to retreat. This state is criminal friendly and has tightly weaved web of laws for normal citizens to follow. Criminals are caught and released. If they have a chance to prosecute a conservative though... Ellison jumps at the chance.
