They only decided not to fast track it. It is still in the docket.

That doesn't mean that SCOTUS has to hear it though. If they wanted to hear it, they would, especially considering there's a week left until the EC vote.

If they didn't want to hear it they'd have thrown it out instead of only deciding not to fast track it.
