Rush said the same thing too... but I think people are missing the difference between the case being docketed, and the case being agreed to be heard. They are two different things. Right now we're just waiting on the response from the states being sued that Alito requested they file by tomorrow.

Well, regardless, it's pretty safe to say that the Supreme court will take this case. It's not like they're going to ignore a state saying this election is unconstitutional, so long as they have a basic argument. Mainly because, if they ignore it, they run a high risk of that state believing the new administration is not legitimate.

You would think that, but don't be shocked if they don't take it. Remember, all Trump SCOTUS cases start down 4-2. Thomas is the only guarantee for us, followed by Alito. Gorsucks and Kavanaugh have already let us down while ACB is a complete unknown.

I don't see any confirmation of this claim by the authoritative SCOTUSBlog. I suspect Prager has confused the case being on the docket with the court agreeing to hear the case. Those are two very different things.
