He can be charged with a Security Matter Compromise to an Unauthorized Individual. For espionage, court would have to prove that he was doing it on behalf of a foreign country. Not saying he didn't commit espionage, but this can be actually hard to prove. Most cases fall back to Security Comprise just because it is easier to prove. Treason is aiding an enemy, usually with malicious intent.
