The confederacy was not some great evil and it wasn't some great good, it was a bunch of people trying to figure something out when they felt the US system failed them, due to a combination of slavery, tariffs, and states' rights as main notable issues. In terms of defining the Union as the group of states that desire to protect the US constitution, then we would be the union. In terms of defining the confederacy as a group of states disillusioned with the US government then we would be the confederacy. It is almost like we are in fact the best parts of both: critical of government, lovers of the constitution.

I believe the only major constitutional violation was the suspension of habeas corpus, that is allowed according to how you read the constitution: "The privilege of the Writ of Habeas Corpus shall not be suspended, unless when in Cases of Rebellion or Invasion the public Safety may require it." This power is assumed to be that of the legislative branch as a part of what section it is in, but it does not make direct mention of the congress. Either way the congress would have likely agreed with Lincoln and suspended habeas corpus as Lincoln had to defend this practice in front of them.
