Apparently when a case comes before SCOTUS no NEW evidence can be introduced at that point - only evidence that was presented in lower courts prior. So if lower courts dismiss without seeing evidence, and the case makes it's way to SCOTUS on appeal, then the evidence can be submitted. So the theory is that lower courts are kicking the can down the road and denying evidence - cause if they allow it it would be the ONLY evidence SCOTUS could consider. Not sure I have my head wrapped around this theory or if I've explained it very well. BUT, since the Texas case is a State vs. State it starts in SCOTUS where ALL evidence can be introduced - which is brilliant.
