Yeah if scotus went 5-4 what if it went 9-0 in favor of Texas. Legitimately not giving the Democrats a leg to stand on at all. Not that they have any legitimacy anyways, but they couldn’t claim it because their wouldn’t be any dissent. Pipe dream but interesting thought is all.
Breyer dissented in Bush v Gore under the same 14th amendment ruling saying SC shouldn't get involved in state-level affairs. He'll likely vote similar here.

Oh I totally agree! But it’d be a thunderclap to close out politics and say that Scotus was above the crap storm that’s current politics.
