They're saying that the constitution didn't really mean the legislature as a body and should be interpreted to mean the legislative process in passing laws (which would then include the governor). They further claim that the courts always have a role in interpreting the constitutionality of the laws the legislature passes. For example if the legislature says you have to pay a fee to vote (poll tax) it would clearly be reviewable by a court as unconstitutional.
So basically...Texas is wrong and even if SCOTUS says they are correct SCOTUS should not give them relief.
