The more adjectives you use, the less strong your argument is. Quick example:

“Biden clearly and blatantly cheated.”

“Biden cheated.”

Which argument is stronger? The second because it uses fewer words and makes you focus on “cheated” instead of whether the adjective is appropriate. Good legal writing is clear and concise. (Also rare.)

Also, my bet is that most of this was written before Texas under the assumption that the claims would be fraud, not the claims Texas brings. The Rudy and Sidney road show is all they thought was coming.

Not a lawyer, but here's my take.

States already have wildly different election procedures, many have the the very same objectionable mail-in schemes as the accused states, only these were legally proscribed by legislatures, not courts or executives.

So the court is being asked to toss the state elections because of the way the laws were enacted, not because the laws are necessarily unfair to Texas et al?

If there isn't a way for SCOTUS to rule on blocking poll watchers, receiving ballots from unqualified voters, and the other fuckery, seems like a tall order to me.

Love to be wrong. Lawyers? Constitutional scholars? Bueller? Anyone?

The core issue raised by the plaintiffs (and largely ignored by the defense) is that the laws were not followed, not that the laws are unfair.

They present a bunch of evidence, including evidence of fraud, which basically points to the fact that the states laws were either ignored or changed by the executives and the courts. If they hadn't, all this fraud wouldn't have occurred, so their results are tainted and must be thrown out.

Wow SOMEONE didn't actually read the filing by Texas, that's actually amazing. The lawsuit isn't seeking to throw out or overturn the results of the election, just to have new electors chosen. They could technically choose to still send Biden electors to vote.

I really hope this is real so we can watch SCOTUS kick their ass.

The whole idea of the Texas lawsuit is that the current slate of electors were appointed unconstitutionally due to the executive branches change of the method of voting/going against voting rules without going through the legislature. By doing so they dilute the vote of everyone in Texas and the other states. It isn't asking SCOTUS to pick the new President - it is asking SCOTUS to rule in favor to throw out the current slate of electors, and tell the State Legislators to choose a new slate of electors.

Texas isn't asking them to choose Trump over Biden, it's just asking for new electors via the legislature. That's why I'm laughing at the responses of the states.

They could convene and choose to vote for Biden still, hence Texas not asking them to overturn the election. It doesn't scream 'FRAUD! PICK TRUMP!' (although we're all hoping that through our calls and our hearings that's what happens). It only screams 'UNCONSTITUTIONAL ELECTION! BYPASS THE GOVENORS AND SOS'S AND PICK NEW ELECTORS"

State law, in EVERY state, and the US and State Constitution says that the LEGISLATORS choose the electors. In this case, it wasn't the legislatures that choose/certified. It was the Executive Branches of the 4 states.

Your thinking is too emotionally involved so you aren't understanding, Texas only wants to make sure the electors are chosen on the basis of the constitution of the United States. Right now they have not been with the executive branch overstepping their power and the checks and balances of the state and us constitution. It has nothing to do with forcing them to choose Trump instead of Biden and Texas has made it clear they aren't asking SCOTUS to choose the new President. They only ask for things kicked back to the legislative branches in each state. Everyone's votes (even the fraudulent ones) haven't changed, have all been cast, and I'm sure the legislators will keep that in mind as they reconvene to choose their new electors, if they choose to do so at all.

What's interesting is that there were apparently some lawsuits (with positive outcomes that what happened was unconstitutional) that were filed the initial changes in 2019 but I don't know what happened with them/I dunno where to find them. It will be interesting to see if SCOTUS uses those results as precedent here, but we'll see.

THIS article right here is part of what the Governors and SOS's bypassed by doing what they did. There are also additional directions similar to what our US Constitution has in the state Constitutions too. If you scroll up the top and read, it also says that All legislative Powers herein granted shall be vested in a Congress of the United States, which shall consist of a Senate and House of Representatives.

If Texas wins the case then the SCOTUS will then send it back to the State Legislatures to rechoose their electors. It is 100% up to them whether or not to choose Trump or Biden and to take into accounts the votes (and voters) of their states. That's the beauty of the Texas lawsuit.

  • Deny the doctrine of separation of powers

I think that the plaintiffs should turn their accusations of 'disenfranchisement' back at them. If there was indeed fraud in the cities, if there was enough fraudulent votes to decide the outcome of the election, then in fact the fraud disenfranchises the majority of people who voted legally in those states. Voters who chose Donald J. Trump to be their president. You cannot disenfranchise people who were not eligible to vote in the first place, people who are dead, or people that don't exist.

Watching some of the hearings showed how ignorant they were about the voting machines.

After seeing the vulnerabilities demonstrated by the Bacon County Board of electors, one can only conclude that those who brought this system into the State of Georgia need to be criminally charged.

I put money it ends up in the majority decision nearly verbatim. The court already ruled on basically the Texas claim earlier in the year. PA ignored Alito too. Not to mention democrats have called at least 4 of the justices rapists or racist

The way they have treated these people will come back to haunt them on this case I think. The law is pretty plain and clear on this issue. Plus it's in their self interest not to let Biden win when democrats are talking about diluting their power.
