Real question, and I know we shouldn't really care what leftists think, but won't GEOTUS' adversaries just accuse him of attacking his political enemies like the dictator they've accused him of being for 4 years. Won't they have the 'high ground' so to speak to say, "See, this is exactly who we said you were" even though he's actually the one protecting the constitution and defending America?

If any modern president has the balls to do it, it’s Trump.

20
shaven_llama 20 points ago +20 / -0

If he has the support within DoD to do it, he should do it if SCOTUS fails.

6
ImReallyRich 6 points ago +6 / -0

If he does it and fails it probably doesn’t make him look good for a 2024 run but I don’t think people really give a shit. I think we want him to do it (insurrection) more than he does

13
FormerGraveheart 13 points ago +13 / -0

If he does it and fails, they'll kill him. 2024 doesn't enter into it.

1
Italians_Invented_2A 1 point ago +1 / -0

If he doesn't do it they'll kill him regardless.

They already said that'll go after Trump when he's out of office. The swamp needs to send a message to any potential future Trumps

3
FormerGraveheart 3 points ago +3 / -0

If he wins through SCOTUS's ruling, then he could appoint a real AG, like Giuliani, and then the swamp could be drained in that way. As long as the prosecutions go all the way to the top, then there shouldn't be anyone left to go after him. Or he could invoke the insurrection act just for the sake of quickly rounding up all the traitors and do it that way. Regardless, as long as he actually does take them all out, he should be fine after leaving office.

Of course if the SCOTUS chooses badly, then the IA is the only choice at that point.

I wasn't really commenting that he shouldn't use it. My point to the GP was that it's foolish to worry about losing. He might be forced into it and then the die is cast, as it were.

2
Italians_Invented_2A 2 points ago +2 / -0 (edited)

The die is already cast for him. Complaining about fraud and then giving up when the corrupt courts rule against you is a suicide. In any possible sense: Trump would go down in history as a sore loser, and then he'll be Epsteined in a prison cell.

If he wins through SCOTUS's ruling, then he could appoint a real AG, like Giuliani, and then the swamp could be drained in that way.

No. If he could drain the swap without using the Insurrection Act, why didn't he appoint Giuliani Right after the elections? Or 4 years ago?

No, the only possible explanation is that the swamp is so deep that the AG doesn't control shit. Maybe Barr isn't a traitor. Maybe Barr is just impotent.

The only way the swamp gets drained is Insurrection Act and either the military or the militia arrest hundreds or thousands of traitors. In government, in the media, in academia, in the courts.

A bit like Erdogan did a few years ago.

Edit: I take that back, Barr is definitely a traitor

2
FormerGraveheart 2 points ago +2 / -0

I think you might be right. I'm still holding out hope that SCOTUS will rule the right way and this can theoretically be solved without bloodshed, but reading here: https://thedonald.win/p/11R4J8FbAD/if-neither-candidate-has-a-major/c/ Apparently, if it goes to the House, Florida has 14 Republican house representatives to 13 Democrats. So then all they'd need to do is flip one of them. And there are probably several such situations...

And Barr is definitely a traitor, but I was thinking that the situation in the DOJ is probably lots of swamp monsters who will be intransigent and refuse to obey orders, hide things from their superiors, or if they're being REALLY sneaky, deliberately sabotage prosecutions. And then there's the matter of all the corrupt judges, too. A real AG would have to fire his way through them all, but it's not out of the question that that might take years. I'm in agreement that the IA seems to be the way to go: otherwise doing it through proper channels might simply take more time than we have.

It's part of a great story. Havel tells the allegory of the vegetable salesman who has to put communist propaganda signs in his window. Havel argues that no one cares about the text of the sign, but it's what the sign means. But the vegetable salesman can lie to himself that the message is fine. But really what the sign means is 'i am a slave to the state and am too afraid to speak the truth' . This is why propaganda is so necessary in communism- it makes everyone afraid of everyone else.it does the regimes job. it's why I will never say BLM.

Almost certainly a code word, much like when certain dogs are named in tweets.

Courage could possibly be hunter’s secret service code word, for example. Since the Biden family has been using C words.

The wisdom code name was used by someone actually convicted in the watergate scandal.

89
Thlayli 89 points ago +90 / -1

I'm probably what a lot of you would consider a normie, albeit a bit more right leaning than most.

I texted my dad the morning after the election that there was election fraud. I knew it in my bones.

Since then I've been following this shit insatiably, and I have come to the conclusion that there was indeed "widespread" election fraud. I used quotes to emphasize, because I don't understand why so many people are afraid of using that term. It's obvious it was widespread.

My lineage goes back all the way to soldiers who fought for George Washington in the American revolution. We've legit got letters in museums. And I come from a long line of military men, myself included.

I can't stomach this. The Constitution and the right to vote are two of the only things that are sacred to me. It's in my blood.

I don't know where to sign up (again) but I will. I'm ready for war. I know what it means and I know it will most likely result in my death. But there are some causes, some purposes, that you just know in your heart that are worth your life.

Our Constitutional Republic is one of them. My ancestors bled for this. I've bled for it already. If it means my life so be it. I took an oath.

And how we burned in the camps later, thinking: What would things have been like if every Security operative, when he went out at night to make an arrest, had been uncertain whether he would return alive and had to say good-bye to his family? Or if, during periods of mass arrests, as for example in Leningrad, when they arrested a quarter of the entire city, people had not simply sat there in their lairs, paling with terror at every bang of the downstairs door and at every step on the staircase, but had understood they had nothing left to lose and had boldly set up in the downstairs hall an ambush of half a dozen people with axes, hammers, pokers, or whatever else was at hand?... The Organs would very quickly have suffered a shortage of officers and transport and, notwithstanding all of Stalin's thirst, the cursed machine would have ground to a halt! If...if...We didn't love freedom enough. And even more – we had no awareness of the real situation.... We purely and simply deserved everything that happened afterward.

Yes. I recognized this months ago. Try to take practical steps, and you're shouted down at once.

Calm before the storm I think. We're all wondering just how bad it's going to be, while at the same time ready to face it.

9
Wtf_socialismreally 9 points ago +9 / -0

I think even the ones ready to face it would be disheartened by seeing what happens to our country, which is why the best course of action -- the safest course of action -- is simply to have the courts side with us, and properly elect Trump.

Next safest is insurrection act.

The worst would be anything happening to our President or him allowing Biden into the White House; that would mean that militias on both sides begin to wreak havoc; militias moving to DC, news outlets and big techie homes.

If their leaders and funding are removed, the left will back down under authority.

They aren't really leaders

But if they feel emboldened by Biden stepping into the White House and the military turned on us, that would be a violent and bloody scenario, possibly worse than the original civil war.

1
Italians_Invented_2A 1 point ago +2 / -1

Exactly. If Biden steps into the White House it's all over for American patriots (and Western civilization). Nothing can be done after that, because if only a part of the military supports him, and they will, patriots have absolutely no chance.

Don't believe the bullshits you see in movies. Civilians can never win against an army with modern technology. Anyone who knows how a Reaper drone works or how fucking indestructible a Abraham M1A2 tank is, understands this.

Trump with the Insurrection Act should have the military on his side. That's the last hope.

The justices have big decisions to make, the electors have big decisions to make. But there is a very very real possibility some of us will soon have to make the choice to pick up a rifle or not.

One thing's for sure...

Trump has put EVERY respected U.S Institution on the spot to show their true colors and reveal whether or not they've been 'infected'. Whether they're fake.

Not even the Supreme Court can evade this test.

Trump has ripped away the strong vibrant facade to show the corpse to the People, that was once their 'country'.

Please don't tell me Trump would give up if the legislatures pick Biden electors.

4
GiggleStick 4 points ago +4 / -0

Yeah what if something like that happens? Is that possible or likely? And is it not possible with the Texas case that they’ll void the votes counted after polls closed and just say trump wins?

9
guitarmastershredder 9 points ago +9 / -0

From what I understand in the contingent election process the majority party in state legislatures send one vote. They can’t switch and vote for the other party.

1
BarnStorm 1 point ago +1 / -0

I understand the electors cant go rogue once apoointed, but a RINO legislature could vote for a Biden elector. -this would not be an elector, but their one vote could be for Biden.

Reading through documents submitted to the SC and thinking through the logic of it, the Texas case is the most brilliant argument possible to be made.

To summarize both the argument and the likely consequences of this.

Texas is basically making the argument that the federal government gives the states the electors and the power to decide those electors through their state legislatures. While these states legislatures are at their own discretion for deciding this, the government only gives the power to their state legislatures. So any argument for how these electoral votes are designated can only be decided by the state legislature. If they are not, they aren’t actual electors, they are just people with an opinion. But this simply reaffirms what’s already true.

Now in the Pennsylvania rebuttal, they simply stated that Texas has no right to intervene in how the state legislates its electors, which is correct. But the argument is they do have a right, because every state only has electors through their state legislature. If they don’t need to derive power from their state legislature, then no state does. If they want to argue that their power doesn’t come from the state legislature, then they are saying that they disagree with how the constitution gives them their electors. Which isn’t the problem. If they want their electors to matter, they have to follow the rules that gave them that power in the first place. Otherwise, they’re following rules for a government that doesn’t exist. If you are part of the USA, this is how you get your electors to count.

Now let’s talk about the consequence of this, which I think is going to be really interesting and the most improtant piece of legislature in the US for a long time. If the Supreme Court rules in favor of Texas, essentially the precedent that will be set is that states can hold other states accountable in their elections in the federal government. This will create a much stronger Union which will keep states in check.

But basically, what Texas needs to prove is that these States didn’t follow their own state laws. These states will need to prove that they did, which would require evidence, either old or new, that would challenge not on the grounds of fraud, but instead from the perspective of if they follow their state legislatures laws. Being fraudulent is for the public opinion, but for the SC doesn’t matter. They just want to know if their process followed their state legislatures laws to validate the power of their electors in the presidential election.

To get more detailed, this effectively means that any election changes, rules, or adjustments within each state that aren’t done explicitly by the state legislature are unconstitutional. States would be able to nullify each other’s electors if any election changes are made outside of the legislative branch. This is good. Because one, it re-establishes the separation of powers, and two, if there are any future lawsuits in each state where there are changes being made outside of the state legislature (like Trump’s team was trying to intervene on), the states courts would immediately rule it unconstitutional because it’s already been decided this would nullify their votes and disenfranchise their states’ voters. Which in effect is what will be argued if these states votes get voided. They disenfranchised their own voters by trying to circumvent state law. Which will REALLY upset their voter base who are going to really want voter protections in place to make sure that can never happen them again and every state will follow suit because they also never want their electors to get voided. This will likely lead toward confusion on how to avoid this, which will neatly lead towards Federal level regulation on election procedure in Congress.

What this specific SC wouldn’t change, however, is if a state (like Nevada did) gets rules passed through their state legislature that do allow these kind of fraud, the SC cannot intervene. So this means that the next battle will be about securing incredibly strong election protections in Congress. But before we get to that, we will need to first get rid of all the representatives that are tainted by this fraud, so they can’t affect the election protections and if they vote against these voter protections, it will make them look reeeeeeallly bad.

All in all, it would highly improbable that the SC doesn’t rule in favor of Texas. It basically just reaffirms that the constitution must be followed. They would basically be ruling to invalidate their own power.

ShiterallyLaking 3 points ago +3 / -0

Well-written summary, I appreciate it fren.

I just hope the court doesn't half-cuck and be like, "This stuff is unconstitutional but we will only apply it to future elections." I dunno if that's even a thing they could do though, cause I'm not a lawyer.

1
Summonblood 1 point ago +1 / -0

Thanks, I hope so as well. I’m very confident they would rule in favor of Texas simply because from the perspective of the SC, how the state legislatures determine their votes is irrelevant. In the eyes of the federal government, the state legislature has always decided the vote for their state. So, how the state legislatures vote is entirely up to them. They could just let people cast their votes and then pick on at random and have that decide their state’s votes.

The only people who disenfranchised their residents are the people who changed the laws without going through the state legislature and convinced their residents that by casting their vote through this system it would actually mean anything.

The greatest irony of this is that it would be constitutional for the state to commit all of this fraud, as long as the state legislature allowed it. The only reason it did matter is because they didn’t. This is why Nevada is not part of the suit.

I am just a fellow layman, but love rhetorical argument & debate and have a huge appreciation for the constitution.

Haven’t read through all the documents to see if all four states violated that, but this seems to be the argument that is being made. What the SC could ultimately rule is that the state legislature ultimately decides and it’s now on the states to bicker internally about that process.

In terms of a Trojan horse for evidence, I think that is one play that they might be going for as icing on the cake, but I can see the democrats trying to cover their ass by saying the fraud is irrelevant to the case.

But, specifically with the Pennsylvania rebuttal, they made arguments about this not being worth the SC’s time, so presenting evidence of fraud in a presidential election would be evidence of that. Which also changes the purpose of the fraud. It’s not about the fraud being 100% true to lead to a conviction, but rather evidence of fraud that makes exploring the case important to consider the constitutionality of the state election changes.

I see it really as a two pronged attack and trying to make the argument that there shouldn’t be any evidence presented and the case itself shouldn’t explore the constitutionality of a state challenging the validation of another’s electoral votes just really makes you suspicious. They really want this to be not settled in the SC, by saying it’s a waste of their time.

Another interesting argument brought up is that the SC should only really be involved in state disputes in the case of a cassus belli, which is a justification of war between the states (like a border conflict). So a much more desperate argument the republicans could make is that this would trigger a war.

1
Italians_Invented_2A 1 point ago +1 / -0

Good summary.

I'd like to add, in at least two states the state legislature passed a law with the Demonrats rules but that law is against the state constitution. We are contesting that too.

There are two layers to this case.

1
Summonblood 1 point ago +1 / -0

Yeah, the constitutionality of the legislature changes would be out of the purview of the SC, and would be handled internally in the state.

But, what could be a way forward is that, as they argue that this is just internal state business, the Supreme Court could rule that it simply recognizes the decision made to assign electors based on what the state legislatures ultimately decide.

Because like the democrats argued that everything else is just State matters if t he state legislature votes to assign electors different than their State laws direct, it doesn’t matter in the eyes of the SC. Which isn’t entirely a fantastic thing, but would make every State uneasy. But at the same time, it would re-enforce the idea of state sovereignty.

1
Italians_Invented_2A 1 point ago +1 / -0

Yeah, the constitutionality of the legislature changes would be out of the purview of the SC, and would be handled internally in the state.

Maybe not. That's what Kelly vs PA case is about. The injunction has been thrown out, but we don't know why.

the Supreme Court could rule that it simply recognizes the decision made to assign electors based on what the state legislatures ultimately decide.

This is what I think it's going to happen.

State legislatures in the 4 states in question will be made to vote on Biden Vs Trump.
