The VP breaks tie break vote in the Senate, so it affects Texas. They waited till safe harbor as states had the chance to resolve the issue themselves, so Texas cannot be said to have waited too late. They couldn't have sued before as the changes to election laws hadn't affected them yet. I would be surprised if scotus doesn't hear this and find that the states didn't violate the Constituion.
But what's interesting will be the remedy.
