I don't think they can, legally speaking. People died in that instance and when that happens there's a legal process that has to happen. They might be able to get the charges dismissed because it's clearly a case of self defense, but I doubt they'll be able to get it dismissed based on claims of the case being brought against him for political purposes. Kyle killed people (entirely justified though it may have been) and that requires that investigations and court proceedings happen no matter how justified the killing(s) were.

Prosecutors do not have the discretion to file bullshit charges for political motives. That's why this prosecutor was dismissed.

I listened to every minute of the Trial and it was outrageous that anyone came away with any other judgement than “not guilty”.
