If SCOTUS declines to even hear then obviously you're correct. If they hear, it should prevail. The legal arguments are sound and valid, and there is enough public pressure for SCOTUS to not simply punt it.
That said, I hope POTUS pulls the trigger on the Insurrection Act if and when necessary.
