Before the Texas case the Court could have rejected appeals from the Trump campaign and voters saying it's a political issue, not for them.
Now any decision they make will be political. Yes, that was true before, but they could say not getting involved was the only way to not be political. Now they can't do that. They piss off the blue States, or they piss off the red States, and they can't split the baby.
Might as well do the right thing then.
There is a difference between making a political decision and one that’s outcome determinative. SCOTUS is not being asked to pick a President. They’ll most likely rule on Constitutionality and, if in favor of Texas, send it back to state legislatures to choose electors. State legislators will probably opt out and send it to the House.
They are unlikely to throw out those 4 states entirely without a path for electors to be seated at all. I think very unlikely. I wouldn’t sweat that scenario too much. I believe it was Alito who said there would be specific remedies available.
The constitution requires a majority or the total electors, not a plurality. If you don't get 270 you can't be elected via electors.
