I have been considering what the SCOTUS might decide based upon 4 states using extra-Constitutional rules (not processed through the legislative process) to gather in votes in 2020. One option would be to say, only votes procured through Constitutionally acceptable methods be counted, others must be discarded.
The left/MSM would scream about uNpReceDenTEd tImEs with COVID-19 forcing states to move quickly (i.e., not legally, no time) to protect the public. Hence my recent post on the framers of the Constituton being painfully aware of smallpox (30% death rate) and NO smallpox clause in the Constitution. MSM must STFU
If SCOTUS said only Constitutionally valid votes be counted, then I believe GA, PA, and WI would move to Trump. MI, NV and AZ I am unclear on.

So impressive they could predict, even in this high tech age, how to prevent elections from being stolen, digitally or with paper ballots, they had us covered. And how important is the second amendment right now to protect the whistle blowers! No one is getting near Jessie Morgan without big problems. Imagine if this was Europe. I believe they will just invalidate the elections in those states since some valid votes were cast unconstitutionally with no intent of the voter. It would be nice, but its better to have the constitutionally tight case that Texas makes, where dissenting is admitting the they believe the constitution does not matter
Very possible. The SCOTUS would end up causing a contingent election as neither side reaches 270. That had been my thought for days now (seems like years, but actually only days).
If they can drill down on the votes and say: this batch came in per legal casting methods, OK count it so as to not disenfranchise the voter. This batch came in per non-legally accepted methods, sorry to potentially disenfranchise them, but that is the fault of the state they reside in - Constitution over feelings
hang on, that's not the relief requested by Texas, Texas is simply asking SCOTUS to send it back to state legislators (after deeming it unconstitutional)
Would they be allowed to direct their own relief if it's not being asked for? Could the relief that Texas is asking for, be seen as a suggestion rather than a request?
So perhaps SCOTUS is not the one to throw out the votes, but forces the states to do so?
If GA, PA and WI move to Trump, that drops Biden below 270. Moves to House vote of state delegations...
If those move to Trump's column, then Trump is above 270, so no contingent election required

As in WI - they had long accepted ruled for Indefinitely Confined voters. Those rules are contained in statutes that went through legal adoption. Those that did apply IC status correctly/legally should be counted, and those that claim IC 'cuz "the Chyna flu might get me if I go in person" (they then proceed on to Walmart...) would be invalid, thrown out.
I think PA had mail in that their legislature realized should go through proper legal adoption, but they simply decided: too hard, too much effort, too little time - just do mass mail in, and Bob's your Uncle.

Were the IC ballots in WI separated from all the other ones though? Cause if not, I don't see how they can do anything but throw out the entire election or else all mail ballots.
Therein lies the rub. I do not know if the ballots are kept in separate piles: same day votes, v IC, etc. If all mixed in, then invalidate the state - no other Constituitionally acceptable choice exists
Not Plausible, too many ballots are missing and too many fraudulent ballots are mixed in with legal ballots.
I agree - if they are mixed then simply throw the whole thing out.
It seems like it is implied that they have the votes in separate piles, from listening to the warroom, but in reality I do not know.
