I was making this argument earlier today on here, this tweet idiot prolly stole it from me.
Argument is simple, 12th amendment clearly states a majority of APPOINTED electors. If SCOTUS doesn't allow the 4 states to appoint electors there is no longer 538 electors. There are 476 APPOINTED electors. Of which only 239 is needed for a majority, hence Biden wins.
This is a real possibility and only requires a direct reading of the 12th amendment. APPOINTED ELECTORS, SCOTUS CAN MAKE IT SO THESE 4 STATES CANNOT APPOINT ELECTORS. HENCE A MAJORITY OF APPOINTED ELECTORS WOULD BE 239 NOT 270.
Barnes needs questioned on this fact, because it is a real possibility.
In Trumps motion to intervene, he calls for 3 actual relief requests.
Electors from these 4 states have their votes ignored. or 2. These states legislatures have to choose new electors or 3. THESE STATES CANNOT APPOINT ELECTORS PERIOD.
Words matter in legalese. 12th amendment clearly states a majority of APPOINTED ELECTORS.
Its not 270 that is needed if SCOTUS goes that route.
Its a big concern I have that gives SCOTUS a way to side with Trump's case, but have Biden win.
