She would have been the fifth vote.
ACB was a lawyer prior to being a Justice.
In 2000 she argued in Bush v Gore that such last minute changes done by executive orders and courts w/o legislative approval were unconstitutional.
She won that case.
It's safe to say that if she's consistent she'd decide the same way as a SCOTUS justice.

Now here's something else that's gonna blow your mind.
Guess who else was making that very same argument in that very same court at the very same time? ACB had two wingmen at her side... and their names are gonna sound VERY familiar to someone like you who's been paying attention.
Who were these Lawyers? Neil Gorsuch and Brett Kavanaugh.
Let that sink in... President Trump put these people in SCOTUS for THIS VERY REASON and THIS VERY MOMENT.
HE KNEW IT WOULD COME TO THIS.
Can I get a source on that? I thought it was John Roberts and not Gorsuch.

They voted on 4-4 to hear the PA case pre election. We can safely assume they will vote this away again which means most likely ACB will be the swing vote.
