That's one option. For example, if this lawsuit wins, it basically says that state legislatures can select their electors that they want. So, state legislatures of PA, GA, WI and MI can select their electors if they want. If that is the case, depending on how much we call our state legislatures, they could end up sending biden electors or trump electors. They can ALSO choose to NOT send electors. In which case, the no one gets over 270 votes, so it goes to congress (where I think a few things can happen, even what you are suggesting above).
