So we are still waiting to hear if SCOTUS will hear the Texas case. What if they don't answer until Monday? That's when the electoral college is supposed to vote. Can they pause the electoral college from voting? Or can they vote, but have their votes overturned? How does this work if we have pending litigation?

My understanding is the court won't stop the ec from voting based on the state certifications even with all the fraud.

The supreme Court ordering the legislatures to vote state by state is the play here and can happen regardless of the electoral college date

By the way, they can 'hear' the case without a hearing. It is only if they call for oral arguments that Cruz and Paxson and the defendants appear before the court.

They may decide that the briefs are enough to decide the case for or against Texas.

That make the defendant’s response so much worse...that is surprising they can rule in favor of Texas just on the briefs alone. I didn’t know that.

They met this morning and peeps in DC say they are still meeting.

They never give an agenda but it's probably not about the Secret Santa gifts.

We will likely hear soon, today through Sunday, but SCOTUS already decided, RBG in Bush V. Gore that the December 14th date is NOT in the Constitution and can be adjusted.

Furthermore Scotus Throckmorton decision of 1878, which is still standing precedent, says that in all cases, not just elections, if there is fraud involved everything deadline wise goes out the window, except the Constitution mandate of the current President's term ends at noon on Jan 20, 2021

That being said, before Sunday night they will almost assuredly rule, decline or ask for oral arguments or more briefs.

If they decline this phase is over.

If they rule in Texas' favor, ask for oral arguments or more briefs the electoral college meeting is on hold until decided or remedied.

The Supreme Court can make any changes to the process until Jan 20 and possibly beyond. The electoral college vote is null and void if fraud is proven.

Theoretically they could wait to issue a ruling until just before Congress is set to read and accept the electors' votes and simply invalidate the electors from the defendant states.

I doubt they will do this though. That is extreme.

If scotus doesn't put a stay on it this weekend, the electoral college will vote Monday. Biden will get his "win", and the left will flip out with joy. Then, when scotus says the four states electors don't count, Pence can use that to not count those votes on Jan 6, declare them contested. The house and senate will each debate that fact for a while, not sure how all that plays out. Probably ends with the house voting for potus, which we will win.

If neither party gets 270 electoral votes the House votes en bloc -- one vote for each state delegation -- for President. So the idea here is SCOTUS would rule the electors from PA/WI/MI/GA are invalid and neither candidate would receive 270.

Good question. Seems as if they respond positively to the lawsuit then the Electoral college will be moot at that time.

Of course Democrats will proceed anyway with their fake votes
