Bush v Gore, where the US Supreme Court waded into the subject of a state's handling of elections, is considered one of the weakest of Supreme Court precedents. Many constitutional experts have said it would be unlikely for Supreme Court to ever want to revisit a situation where an election hangs on the decisions of unelected judges. Today the US Supreme Court reiterated they do not want to position themselves as the role of kingmaker, no matter how indirectly. So be it.

But what this means in practical terms is that whatever happens as a result of a legislative process--NO MATTER HOW UNORTHODOX OR UNUSUAL--will be allowed to stand. Nobody will be able to run to court for relief because it will be denied.

Remember those memes about Mike Pence pulling out an extra box of electors from under a table? It could literally happen and Democrats would have no recourse because the Supreme Court will not get involved. But we obviously aren't going to cheat like dirty stinking Democrats so what else could Pence do?

What about rejecting electors from states with pending allegations of fraud? What about deciding in his role as President of the Senate to hold a simple majority vote of whether alternate slates of electors should be allowed? What about allowing a motion to delay the counting of electors a month so the truth about Biden corruption plays out?

The potential is now limitless because no matter what Mike Pence does, the US Supreme Court has signaled that Article III (the courts) will not get involved in Article II (legislative) affairs surrounding an election.

So ultimately, the future of this country will be in the hands of Mike Pence. If so many electors are set aside that it becomes impossible for either candidate to reach 270, then it falls back to the House to vote by state delegation where there are currently 27 Republican legislatures and 23 Democrat.

Mike Pence has proven to be one of Trump's most loyal and faithful supporters. I believe if there is anything that can be done to right this injustice, Pence will have both the courage and conviction to do it.

My only concern with Pence is he's been eerily quiet. Literally all he's said about this stuff since election night was one milquetoast tweet saying that all legal votes should be counted. Not ONE show of support, strong statement, tweet, or ANYTHING since then let alone any action. Even on conservative websites rumors were flying that he's trying to distance himself from this whole thing in hope to save himself from any fallout later. Obviously it could be fake news, but I'm inclined to believe it because what else could possibly explain his deafening silence here? No. He can't flip the electors. He can throw them out. If Trump doesn't have 270, then he wouldn't get it.

You'd be taking them away from Biden so neither has 270 so it'd go to delegates.

That's the way it goes. And that's if a Senator has the balls to contest it. You need a rep and senator to contest the electors before Pence can chuck them, which that's difficult. It's going to be REALLY hard to get a senator to actually do the right thing and contest and it's going to be hard to get Pence to man up and chuck the electors.

That requires extreme loyalty to Trump and courage to stand up. And I don't know if any Senator is man enough. And I"m not sure Pence would it. He might be to straight and narrow and it'd be easy to view that tactic as being real underhanded and cheap.

This will not be the last case the Supreme Court hears on the election, there’s the 4 individual lawsuits between Trump and each commie state.

If I were the Supreme Court, as legendary as an unprecedented lawsuit sounds, you ARE setting the precedent.

I think they are waiting for the 4 true lawsuits to be appealed the traditional way, so then they can turn this over using the precedent that only state legislators can change election rules. It’s just much simpler in their eyes.

This does help with optics of an impartial Supreme Court. I wish they took up this case, and were brave enough to go on setting a good and wise precedent.

Im just trying to take this rationally. We’re talking about State vs. State lawsuits. Could them taking this case have opened a can of worms for a Supreme Court becoming bombarded with nonstop similar lawsuits?

Also, a senator and a member of the house of reps. is required to contest the electoral votes for it to go to Pence for him to stop it. There's a Rep from like AL or SC that said he was going to object to the electoral slates of those states, but there also needs to be a Senator to step up and none have. And I suspect none will. They're all so ingrained in their little rules that none would day step out of line to do someone that can be perceived as bad for the right reasons.

Don't expect Rand Paul, Ted Cruz, Gaetz, whatever R to do it. They're going to stay silent. Because that's what they do. None have the courage when it matters.
