Understand there are lawsuits in place in the battleground states, but seeing how there haven't been any legal victories yet. What mechanism if any is place that will prevent a Biden electoral college victory? Are those battleground electoral votes in limbo until the suits are resolved or have a final appeal at the supreme court? I understand the 12/14 date is a Federal Statute and has no constitutional basis.

The congressional certification of the election? From what I understand in a contested election by 14th amendment each state would get one vote, and the vote would be by majority party for the state delegation, so republicans would have the advantage. But I don't think this is the same as what you are referring to, wouldn't that just break down by majority which the Dems have.
They can send it to legislatures up until January 6th.
